1. Liability Waiver

Except as otherwise stated in this section, the service is provided “as is” without warranty of any kind, either express or implied, including without limitation any warranties of merchantability or fitness for a particular purpose. Purely Positive Dog Training LLC neither assures nor assumes any liability to any person or entity for the proper performance of services. Purely Positive Dog Training LLC does not represent or warrant that the service is complete or free from error, and does not assume, and expressly disclaims, any liability to any person or entity for loss or damage caused by errors or omissions in the service, whether such errors or commissions result from negligence, accident, or other cause.

Further, I am and will remain responsible for the actions of my dog at all times and I hereby agree to indemnify and hold harmless Purely Positive Dog Training LLC of any and all claims of injury, expense, costs, or damages caused by the actions of my dog while under Purely Positive Dog Training LLC instruction or control and under my own care as a result of following training instructions. I have been told by Purely Positive Dog Training LLC and understand the inherent risks of owning a dog, including, but not limited to, the risk of dog bites to myself or others.

I warrant and represent that I will remain aware of and abide by local laws and public guidance to reduce my exposure to COVID-19 and will follow best practices in receipt of Purely Positive Dog Training LLC’s services, including wearing a mask and maintaining six feet of distance. I further warrant that I will cancel any in-person services should I experience any symptoms of COVID-19, have knowledge that I was exposed to COVID-19, or test positive for COVID-19 and that Purely Positive Dog Training LLC has the right to reschedule my appointment or offer the appointment in an alternative mode of service. 

2. Payment Policy

All purchased lessons must be completed within 90 days of registration. After 90 days, the value of the lesson or lessons is reduced by 50%. After 180 days, the value of the lesson or lessons is reduced by 75%. After 12 months, there is no value for a lesson or lessons. There is a $25 charge to process a refund.

3. Cancellation Policy

I understand that when I schedule a training session that time is mine. I understand cancellations on short notice do not provide adequate opportunity for Purely Positive Dog Training LLC to schedule another client, resulting in financial loss. As such, I understand and acknowledge that if I cancel an appointment with less than 24 hours’ notice, I will be billed for the appointment, and the appointment will not be rescheduled. 

I further understand that changes in service due to COVID-19 are not grounds for cancellation or refunds and that Purely Positive Dog Training LLC reserves the right to change the mode of service (for example, from in-person to online) or trainer as deemed necessary by Purely Positive Dog Training LLC to deliver services as scheduled.
